Caryn L. Lilling

Some cases require more than a strong defense. They require a different way of thinking.

Caryn Lilling helps clients navigate the strategic decisions that shape the outcome of high-exposure litigation. Insurance carriers, hospitals, corporations, and defense counsel turn to her when legal issues are complex, the financial stakes are significant, or the path forward is uncertain. Whether a case is headed toward trial, mediation, appeal, or resolution, she helps clients evaluate risk, identify opportunities, and develop strategies that improve outcomes.

Although nationally recognized for her appellate practice, much of Caryn's work begins long before an appeal is filed. She is frequently engaged during the pretrial, trial, mediation, and post-trial stages of litigation, where her appellate perspective helps identify critical legal issues, preserve appellate arguments, evaluate verdict risk, and guide strategic decision-making throughout the life of a case.

Caryn also serves as trial monitoring counsel in complex litigation, providing insurers and corporate clients with an independent strategic assessment as trials unfold. She analyzes emerging legal issues, liability and damages themes, and preservation of the record, helping clients recognize opportunities and make informed decisions at pivotal stages of trial.

As co-founder and chair of the firm's National Damages Mitigation Program, Caryn advises insurers, hospitals, corporations, and defense counsel on reducing exposure in catastrophic injury litigation. She works extensively with future medical expenses, life-care planning, economic damages, and other issues that often drive settlement value and verdict exposure, helping clients challenge assumptions that significantly affect case value.

She also advises clients on emerging and unsettled legal issues requiring thoughtful analysis and practical solutions, including COVID-19 healthcare immunities, professional liability claims involving mental health providers, and other complex litigation matters.

A frequent author and speaker, Caryn presents on appellate advocacy, litigation strategy, damages mitigation, and complex claims management for insurance carriers, healthcare organizations, professional associations, and continuing legal education programs.

Caryn earned her undergraduate degree from the University of Michigan and her Juris Doctor from Hofstra University School of Law. She is admitted to practice in New York and New Jersey, before the United States Court of Appeals for the Second Circuit, and before the Supreme Court of the United States. She holds Martindale-Hubbell's AV Preeminent® rating.
