Appellate Advocacy

Appellate advocacy has been the foundation of Mauro Lilling Naparty LLP since its founding in 1992.

Today, MLN is one of the nation’s largest firms devoted exclusively to appellate practice, working with insurers, corporations, and defense counsel in state and federal courts throughout the country. Our attorneys, including former appellate court law clerks, combine rigorous legal analysis with practical strategic insight. We do more than identify legal arguments—we evaluate how appellate issues fit within the broader litigation strategy and advocate for outcomes that advance our clients’ objectives. Whether challenging adverse rulings, defending favorable results, or evaluating complex legal issues before an appeal becomes necessary, clients turn to MLN for objective analysis, persuasive advocacy, and a perspective shaped by decades of appellate experience.

Dispositive Motions

Many appeals are won or lost long before a notice of appeal is ever filed.

MLN is frequently engaged to prepare, review, and strategize dispositive and other substantive motions that may ultimately define the course of a case. By becoming involved early, we help clients preserve critical issues, develop a strong record, and position cases for success both in the trial court and on appeal.

Our attorneys regularly assist with motions to dismiss, summary judgment motions, motions in limine, and discovery motions involving significant legal, evidentiary, or procedural issues. Early strategic involvement often creates opportunities that cannot be recovered once a motion has been made or the record is closed.

Trial Monitoring & Strategy

A single ruling, objection, evidentiary decision, or strategic choice during trial can significantly affect the outcome of a case and the prospects for appellate relief.

MLN works alongside trial counsel to identify and preserve appellate issues, evaluate trial strategy, and provide an objective perspective during critical stages of litigation. Our attorneys monitor proceedings in real time, assist with motions and legal arguments as issues arise, and help ensure that the record accurately reflects the issues most likely to influence post-trial motions and appellate review. By combining appellate insight with practical litigation strategy, we help clients make informed decisions when they matter most.

Damages Analysis & Mitigation

In high-exposure litigation, the defense of damages is every bit as important as the defense of liability.

MLN has developed a national practice focused on evaluating, challenging, and mitigating damages in complex tort and catastrophic injury matters. We work with clients to identify opportunities to reduce exposure through strategic discovery, expert development, motion practice, and settlement evaluation.

Our approach includes analyzing future medical expenses, life care plans, economic damages, collateral source issues, and the reasonable value of medical services. By addressing damages early and aggressively, we help clients achieve more favorable outcomes at trial, during mediation, and in settlement negotiations.

Mediation Support

Successful mediation requires more than a willingness to negotiate. It requires a clear understanding of risk, exposure, and the legal issues most likely to influence the ultimate outcome of the case.

MLN assists clients and trial counsel in evaluating liability, damages, appellate risk, and settlement strategy before and during mediation. Our attorneys provide objective assessments designed to identify strengths, vulnerabilities, and opportunities that may not be apparent from the day-to-day management of the litigation. By bringing an independent strategic perspective to the mediation process, we help clients make informed decisions and pursue resolutions that align with their litigation objectives.

Risk Transfer & Coverage Issues

Understanding who bears the risk is often as important as defending the underlying claim.

MLN advises insurers and corporate clients on complex insurance coverage, indemnification, contribution, and contractual risk transfer issues. Our attorneys evaluate contracts, policy language, and applicable law to identify opportunities to transfer, allocate, or limit exposure. When disputes arise, we represent clients in coverage litigation and declaratory judgment actions, applying the same analytical rigor and strategic approach that define our appellate practice. Our goal is to ensure that risks are properly understood, appropriately allocated, and effectively managed.

Emerging Liability Defenses

The legal landscape is constantly evolving, creating new statutory defenses, immunities, and liability protections that can dramatically affect the outcome of litigation.

MLN helps clients identify and leverage emerging legal defenses arising from legislative developments, regulatory changes, and evolving case law. Our attorneys have been at the forefront of issues such as COVID-19 immunity, statutory liability protections, and other developing defenses affecting insurers, healthcare providers, corporations, and public entities. By staying ahead of legal developments, we help clients recognize opportunities that may significantly alter the trajectory of a case.
