Bustos v. Lenox Hill Hospital (2014)

Bustos v. Lenox Hill Hospital (2014): the Court of Appeals has now affirmed our prior, successful appeal to the Appellate Division, First Department. We were originally retained to appeal from plaintiff’s $5.5 million jury award for alleged injuries to a mother during the birthing process. The First Department had reversed the plaintiff’s verdict on the basis that the plaintiff’s expert’s testimony was insufficient and, as a result, vacated the $5.5 million award against our client. Thereafter, the plaintiff obtained leave from the First Department to appeal to the Court of Appeals.  Ultimately, the Court of Appeals agreed with our position and dismissed the complaint.
