High Exposure Litigation Program

The purpose of our High Exposure Litigation Program (“HELP”) program is to provide an alternative to the traditional model of case handling, so that select matters do not pass through the same routinized pre-trial preparation process.  As an appellate firm, we are best suited to identify key legal issues from the outset and fully develop those issues throughout discovery to ensure that every key issue is identified and properly framed, and that all available defenses are thoroughly explored and implemented.  This approach increases the likelihood of obtaining summary judgment or, at the very least, ensuring that questions of fact remain in challenging liability cases. 

MLN also has a strong emphasis on defending damages.  We serve as National Coordinating Counsel on Damages for several major insurance carriers and hospitals.  Our comprehensive approach to defending damages, specifically inflated claims for future medical expenses, is highly effective both in creating leverage for more favorable settlements as well as defending damages at trial. 

What also makes us different is that we do not handle a high volume of cases from inception.  As a result, our attorneys have the ability to offer a greater level of personal attention and a heightened focus on each case.  This ensures that every key issue is identified and properly framed, and that all available defenses are thoroughly explored and implemented.  And since approximately 95% of cases settle prior to verdict -- particularly in high exposure litigation -- our preparation and attention to detail early on in the litigation will provide greater leverage for settlement.  High exposure lawsuits and those involving thorny liability issues that could impact future cases warrant a higher level of scrutiny from inception, through discovery and deposition, during mediation, and at all phases of the pre-trial process.  And that is exactly what MLN’s HELP program offers.
