In a recent article for the New York State Bar Association Journal, retired Associate Justice of the Appellate Division, First Department, Bentley Kassal, asserts that “certain definite trends
are discernible” in official appellate data compiled from New York's principal courts. There are
“valid statistical conclusions as to the numerical likelihood of success in a given court, based
solely on actual history.”
