Mr. O'Shaughnessy is a partner in the firm. He has practiced appellate litigation for over 20 years. Before joining MLN in 2010, Mr. O'Shaughnessy was the partner in charge of appeals for 11 years at McAloon & Friedman, P.C., a highly regarded New York City medical malpractice defense firm. Prior to that, he served as Assistant Corporation Counsel for the City of New York in the Law Department's Appeals Division.

Notably, he has briefed approximately 300 appeals and argued the overwhelming majority of them. He has also drafted countless summary judgment and other dispositive motions as well as trial memoranda of law. Among his most significant recent decisions are: Silberstein v. Maimonides Medical Center, 77 A.D.3d 910 (2d Dept, 2010) (Supreme Court did not err in directing plaintiffs to disclose name of probable joint tortfeasor); Lawlor v. Lenox Hill Hospital, 74 A.D.3d 695 (1st Dept), leave to appeal denied, 2010 N.Y. Slip Op. 88010 (2010) (no malpractice in treatment of patient suffering alcohol withdrawal where patient could not have been involuntarily committed); Avins v. Federated Employment and Guidance Services, Inc., 67 A.D.3d 505 (1st Dept, 2009) (supportive housing provider owed no duty to member of public injured by client); Carter v. Isabella Geriatric Center, Inc., 71 A.D.3d 443 (1st Dept, 2010) (expert disclosure was not sufficiently specific and did not sufficiently distinguish between claims of malpractice and claims of ordinary negligence); Cadichon v. Facelle, 71 A.D.3d 520 (1st Dept) (plaintiff failed to demonstrate reasonable excuse for failure to file notice of claim despite plaintiff's argument that defendants were responsible for delay); Varon v. Maimonides Medical Center, 67 A.D.3d 779 (2d Dept, 2009) (plaintiff not entitled to additional time to serve defendant hospital); Crucen v. Leary, 55 A.D.3d 510 (1st Dept, 2008) (complaint dismissed for failure to comply with National Childhood Vaccine Injury Act despite fact that plaintiffs argued that injuries were not vaccine-related).

Mr. O'Shaughnessy is a former federal law clerk and a graduate of Swarthmore College and Harvard Law School.
